ELM RD., an ELM RD. Limited brand, (‘ELM RD., ‘we’, ‘us’ or ‘our’) provides the content of the Website.

Your use of and access to the Website is subject to the terms and conditions set out in this notice and in our Privacy Policy, and to all applicable legislation. These terms and conditions establish a contract between you and us. When you use any part of the Website in any way, you accept and agree to be legally bound by these terms and conditions. If you do not accept these terms and conditions you must immediately stop using the Website.
 

We may change these terms and conditions at any time and without notice. When changes to the terms and conditions occur, updated terms and conditions will be published online at the earliest practical opportunity. It is your responsibility to regularly review these terms and conditions to ensure your continued compliance.
 

This Website also contains links to other websites, which are not operated by ELM RD. or ELM RD. Limited (the ‘Linked Sites’). We have no control over the Linked Sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms and conditions contained within each of those sites.
 

Use of the Website

ELM Rd. Limited is the supplier of all goods sold on the Website. When using the Website you declare that all information provided to us by you is true, accurate, complete and current. You promise to inform us of any changes in your personal information at the earliest opportunity by contacting hello@elmrd.com.

Our Privacy Policy, which sets out how we will use your information, can be found here . By using this Website you consent to the processing described therein and warrant that the data provided by you are accurate.

Description of goods

We try to make sure that the Website always contains the most accurate information, however, we’re human beings so we can’t guarantee this. This means that (so far as the law allows us) we aren’t declaring in any way that the information on the Website, including but not limited to descriptions and depictions of materials, colours and styles, is up to date, complete, accurate, reliable or otherwise free from error.

The designs, samples, drawings, descriptive matter, specifications and advertising issued by us, including (without limitation) all images, designs, drawings, or illustrations on this Website, are issued or published by us for the sole purpose of giving an approximate idea of the product described.

Furthermore, the colour of images which appear on the Website may be limited by the availability of images, colours or shades, or by the technology you are using to access the Website. Different web browsers and receiving devices may display different shades or colours. Therefore, even though we strive to achieve the best image quality and clarity on this Website, we can’t guarantee that any images, colours or shades will look the same on every device or browser you might be using. The colour and texture of the material may vary.

Acceptance of orders

Once you place an order it cannot be cancelled. If you make a mistake on your order, please contact us as soon as possible.
 

We reserve the right to reject any order, for any reason, irrespective of whether payment has been made or received. This may happen if an item is out of stock, or if an error in price or description is found on the Website. 

Payment

We are not liable for delays or cancellation in instances where we are unable to obtain authorisation for any payment that you make. This applies regardless of the reason we are unable to obtain said authorisation.

Risk in the goods

Risk in the goods transfers to you upon delivery of the goods.

Property in the goods

You don’t own property in the goods until such time as we have received and processed full, authorised and non-fraudulent payment from you. Until such time, we retain the legal ownership of the goods. Upon receipt of said full payment, property in the goods will be transferred to you.

 

Discounts and promotions

Discounts are issued and presented in two formats, either ‘savings’ or ‘percentage off’. Any such discounts are offered to customers via promotional emails, advertisements or third-party communications. There are no cash or credit alternatives and all terms and conditions are non-negotiable.

All promotions have a ‘valid until’ or ‘expiration date’, please refer to the original promotion source for details. We reserve the right to cancel or change any promotion or discount without notice and at any time.

Promotional codes are valid for one transaction per person, cannot be used on multiple accounts and may not be used in conjunction with any other offer. Promotional codes may not be applied retrospectively to prior orders.

When returning an item purchased using a promotional code, you will be refunded the purchase price based on the promotion, rather than the original value.

Competition prizes

All prizes are non-negotiable and non-refundable. There is no cash or credit alternative. Competitions and prizes are variable; please refer to the competition source for details of the full terms and conditions. Similar to all purchases (either with or without gift vouchers), all our usual terms and conditions apply.

 

Gift vouchers

All gift vouchers are valid for six (6) months from the date of issue. Any gift vouchers issued as part of an exchange or issued as credit will be set to expire from the date of the gift voucher purchase. Any gift voucher presented for use after the six (6) month validity period has expired is not redeemable against any purchase. Please note no cash or credit equivalent is available.

 

​No promotional codes can be used together with gift vouchers.

 

Delivery

When placing an order, you must provide us with a delivery address. We intend to deliver the goods to you within forty-eight (48) hours of receiving of your order, however, we cannot guarantee delivery within this time frame.

An order received by us after 12:00 p.m. (GMT) on any working day is deemed to have been received by us at 9:00 a.m. on the subsequent working day. An order received on a non-working day is deemed to have been received by us at 9:00 a.m. on the subsequent working day.


Please note: If you have ordered more than one item, we may deliver each item separately and reserve the right to do so.

 

Receipt of goods

​We require that you examine the goods upon receipt. In any event, you will be deemed to have done so.

We will not accept liability for any non-delivery of any goods, except where you provide written notice of the non-delivery within five (5) working days of the date when the goods would or should, in the ordinary course of events, have been received by you. Any liability for the non-delivery of goods shall be limited to replacing the goods within a reasonable time or issuing either a credit note or voucher against any invoice raised, or payment made in respect of such goods.

We provide an optional ‘signed for’ delivery service. If you choose this service during checkout, your parcel will not be left without a signature. Irrespective of the reason, you accept liability for the return cost and any additional postage costs.

 

Returning goods

It’s very important to us that you’re happy with your ELM RD. product and we’ll always act in good faith to resolve any issues you might have.

Returning faulty goods

Goods are considered faulty when they are received damaged (except in cases where damage was stated to the customer at the point of purchase). For all faulty items outside of our Returns Policy, please contact us at hello@elmrd.com.
 

If upon receiving your goods, you believe that item(s) are faulty due to a production fault, please contact us within seven (7) days of delivery and we will do our utmost to help you. Please return your product as instructed by us. Please don’t return any goods to us without first informing us that you are doing so. None of this affects your statutory rights in any way.
 

If you’re returning goods to us from outside the UK it’s your responsibility to fill out a CN22 customs form. You must state that the item is returned goods. Packages returned without a CN22 customs form, or which don’t state that goods are returned goods will automatically be rejected and returned to sender. This procedure is beyond our control so please be careful to complete this step.

Please remember to ask your post office for proof of postage and to keep this for your reference.

 

Intellectual property

Limited goods and services are subject to various forms of intellectual property including but not limited to any copyright, design rights and trademarks that we are or may be entitled to. Nothing contained in these terms shall be construed as conferring by implication or otherwise any license or right to use any trademark, patent, design right or copyright or other intellectual property right of ELM RD. or ELM RD. Limited.

Content from the Website may not be copied, broadcast, republished, downloaded, reproduced, posted, transmitted, made available to the public, or otherwise used in any way or for any reason other than for your own personal, non-commercial use.
 

You further agree not to adapt, alter or create any work derived from the Website except for your own personal, non-commercial use.

Request for permission to use any content from the Website may be made by contacting us in writing. Any and all written requests for permission may be refused on grounds of our choosing and we are not obliged to disclose to you any reason or reasons for our refusal.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. If there is any conflict between these terms and conditions and any other more specific terms and conditions contained anywhere else on the Website, the ELM RD. terms and conditions shall prevail.

 

Severance of terms

If any provision of these terms and conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from these terms and conditions and rendered ineffective as far as possible without modifying the remaining provisions of these terms and conditions, and shall not in any way affect any other circumstances of or the validity or enforcement of these terms and conditions.
